Fundraising Terms & Conditions – Online Fundraisers
TERMS
“the fundraiser” refers to the individual/organisation or group that is holding the fundraising activity on behalf of Lifeline Australia
“Lifeline or LLA” refers to Lifeline Australia
Prior to completing this fundraising registration process please read all of the following information about responsibilities and expectations of your role when fundraising for Lifeline Australia.
FUNDRAISER’S RESPONSIBILITY
Your responsibilities as a fundraiser for Lifeline Australia:
Any person, organisation or group (referred to below as the ‘the fundraiser’) who wishes to fundraise for Lifeline Australia must accept the following responsibilities:
- The event will be conducted in the fundraiser’s name, who will be solely responsible for managing the fundraising activity in an appropriate and responsible way.
- The fundraiser must comply with all obligations imposed by fundraising legislation or regulations in their relevant State or Territory. Any necessary permits, authorities to fundraise, insurance, or licenses must be secured by the fundraiser, prior to the event.
- The fundraiser is responsible for ensuring the safety of the event, including organising appropriate public liability insurance and providing first aid services if required.
- All funds raised by the fundraiser from the public will be made directly to your fundraising page or held on behalf of Lifeline Australia by the fundraiser until the initiative is completed. The fundraiser needs to make sure that the funds are kept in a secure place, full records of income are made and that these are sent to Lifeline Australia within 28 days of the event taking place. It is a legal requirement that all funds are banked within 28 days of any fundraising activity. Fundraisers are not permitted to retain money from one year to the next. Please contact Lifeline Australia for banking details if required.
- Children under the age of 18 years of age must be accompanied by an adult when collecting donations of money or other fundraising activity.
- The fundraiser agrees to release LLA to the extent permissible under the law for all claims and demands of any kind associated with the event, for all liability or costs that may arise in respect to any damage, loss or injury occurring to any person in any way associated with the event caused by the fundraiser’s breach of these responsibilities or the fundraiser’s negligence.
- Lifeline Australia reserves the right to terminate our support for the fundraising activity or event at any time if it appears that there is a likelihood of the fundraiser failing to meet any of the responsibilities specified in these terms & conditions.
The fundraiser:
- agrees to receive further updates from Lifeline Northern Beaches and Lifeline Australia
- verifies that they are in proper physical and mental condition to organise and run the fundraising event and acknowledge that they are aware of the risks involved and voluntarily agree to assume those risks.
- agrees that should the fundraising activity place undue stress, duress, distress to them financially, socially or on their physical and mental wellbeing; they will notify Lifeline Australia immediately and in doing so Lifeline Australia reserves the right to withdraw the authority to fundraise.
- agrees to conduct themselves in a befitting manner representing Lifeline Australia. Any behaviour deemed to be damaging Lifeline’s good name or good will in the community will result in immediate termination of the fundraiser’s approval to fundraise.will make it clear when dealing with the public, sponsors and supporters that the fundraiser is not representing Lifeline Australia and that they are raising funds that will be forwarded onto Lifeline.
- agrees that at no time will they or any people involved in their activity, present themselves as a representative or staff member of Lifeline.
- will engage in a reasonable level of liaison with Lifeline Australia and provide relevant requested information regarding the fundraising activity in a timely manner.
- will advise Lifeline Australia of changes made from the details provided during the registration process, including the cancellation of the activity, within two days of the date of the change and before the commencement of the activity.
- shall not undertake any door-to-door, street sales, telephone-based approaches for donations in connection with the activity.
- acknowledges that the activity is moral and ethical, and it does not involve any industries that are in conflict with the values and purpose of Lifeline Australia.
- agrees to have their fundraising page archived after 12 months and approval to fundraise will cease, unless advised otherwise by Lifeline Australia.
FINANCIAL AND ADMINISTRATIVE
The financial, fundraising, raffles, record keeping, and management aspects of the activity are entirely the fundraiser’s responsibility and they must comply with any obligations imposed by the applicable legislation, rules or regulations in the jurisdiction where they operate.
The fundraiser must keep records sufficient to enable true and fair view of the income and expenditure relating to the appeal to be ascertained at any given time in accordance with the legislation in the relevant jurisdiction.
EXPENSES
The fundraiser must:
- Not incur any expenses in the name of Lifeline.I The fundraiser may deduct any vital costs associated with organising the activity provided they are well documented and are ‘fair and reasonable’, and can only include out-of-pocket expenses such as venue hire, catering, etc.
- Ensure the fundraising activity will be self-funding and all related invoices are paid for by the fundraiser. Lifeline Australia will not be held liable for any losses or expenses incurred by the fundraiser in any circumstances and no invoice should be addressed to Lifeline.
- Expenses should not exceed 50% total funds raised.
- Maintain and provide an accurate and complete statement of income and expenditure along with copies of receipts for all expenditure. These must be retained for at least 12 months after the activity.
DONOR RECEIPTS
Lifeline Australia is a registered charity and donations of $2 or more are tax deductible. Please note that the Australian Taxation Office have ruled that donations are not tax-deductible if a person receives goods or services in return for the money given (i.e. the purchase of any services or items, raffle / action / competition tickets or event entry tickets etc.) For further information on tax deductibility visit the Australian Taxation Office website, https://www.ato.gov.au
MARKETING, PROMOTION AND USE OF LOGO
MEDIA
Due to limited resources, Lifeline cannot undertake media relations for the organiser.
The fundraiser must only use Lifeline’s logos in accordance with the Media Guidelines.
All marketing and media materials, including press releases, must be approved by Lifeline prior to distribution.
Lifeline must be notified of all planned media activity in advance, and of all unplanned media activity immediately.
Any approach made to celebrities for support must be discussed with Lifeline and approved prior to any contact being made.
A representative from Lifeline may be available to attend your fundraising activity however, the request must be made well in advance of the event. Determination for representation will be based upon staff availability and date of event.
MARKETING
The level, mode and/or percentage of support for Lifeline must be explicitly stated on all materials and correspondence relating to the fundraising activity, e.g. 100% of proceeds will be donated; 100% profit will be donated; $x per item will be donated; income will be split with another charity, etc.
Lifeline must always be identified as the ‘beneficiary’ of the fundraising activity. The organiser has no right to the names ‘Lifeline Australia’ and ‘Lifeline’. In naming the event ‘Lifeline’ should not be used in the title however, the fundraising activity may be promoted as ‘proudly supporting Lifeline’.
Prior approval must be sought from Lifeline for any promotional materials (printed or electronic) or advertisements associated with the fundraising activity, including use of Lifeline Australia’s supporter logo.
Permission for logo usage may attract conditions, negotiated between Lifeline and the fundraiser, especially if the use of logo is for marketing activities of an organisation, and a minimum donation may have to be guaranteed.
The fundraiser must:
- Indemnify Lifeline Australia against any liability, action, claim, suit, damage, cost and expense (including all legal fees), to the extent that a claim or action brought against Lifeline is connected to, in relation to or arising out of the fundraiser’s:
a) Negligence; or
b) Breach of, or default under, this Agreement
- Supply all information provided to Lifeline to the relevant government agencies in their state upon request should licenses be required.
- Agree to release Lifeline to the fullest extent permissible under law for all claims and demands of any kind in any way associated with the activity, and Lifeline from all liability, claims or costs that may arise in respect of any damage, loss or injury, whether physical or financial, occurring to any person in any way associated with the activity.
- Agree that Lifeline accepts no responsibility for any food related accidents or injuries that may occur during a fundraising activity or event including food allergies, adverse reactions, food poisoning, anaphylaxis, other illnesses or sickness caused by food products and/or their preparation, storage, handling, presentation or consumption.
- Acknowledge that the public liability insurance and other insurance policies held by Lifeline do not cover events or fundraising activities conducted by outside groups or individuals.
- Provide a detailed event plan for any physical endurance events, e.g. running across Australia. This plan must include details such as the route, dates, duration, insurance, budget, support team, risk mitigation strategy, sponsorship and experience.
